Terms and Conditions for Privé Pilates

Welcome to Privé Pilates! These Terms and Conditions ("Terms") outline the rules and regulations for using our studio, website, and services. By accessing or using our services, you agree to comply with these Terms. If you do not agree with any part of these Terms, please refrain from using our services. By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”, “Policy”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service. Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

These Terms and Conditions apply to all clients, staff members, contractors, freelancers, and any other individuals or companies engaging with Privé Pilates, either directly or indirectly.

1.4 These Terms apply to all clients, website users, visitors, staff, freelancers, and contractors ("Participants").

1.5. Purpose of Our Studio

Our studio is dedicated to providing a safe, private, and culturally inclusive space for women, including those who observe religious modesty requirements such as the wearing of hijabs. Many of our members require an environment where they can move freely, remove head coverings, and participate in activities without concern for male presence.

1.6 Our Women-Only Policy

To uphold the privacy and dignity of our members, access to the studio is restricted to biological women only during regular class schedule. Private classes/ events or functions can be booked/attended by anyone. This policy is in place to:

• Ensure Muslim women and other women who observe modesty rules can participate comfortably.

• Protect the religious and cultural rights of attendees who require separation from biological males.

• Maintain an environment where members feel fully able to engage in activities without restrictions.

1.7 Legal Basis for This Policy

Under the Equality Act 2010 (Schedule 3, Paragraph 28), businesses are permitted to offer single-sex services where it is a proportionate means of achieving a legitimate aim. We have established this policy based on:

• The necessity of providing a faith-compliant space for Muslim women.

• The fact that alternative arrangements (such as private changing areas) do not fully meet the needs of women who follow modesty requirements.

• Our commitment to ensuring equal access to services that would otherwise be inaccessible to religious women.

1.8 Membership Eligibility

To become a member of our studio, applicants must:

✔ Be a biological female (assigned female at birth).

✔ Understand and respect the religious and cultural sensitivities of fellow members.

✔ Follow the studio’s privacy and modesty rules.

2. Booking and Payments

2.1 Class Bookings

• Classes can only be booked and managed online through our website or our App.
• In-studio purchases, money transfers, or cash exchanges are not permitted.

2.2 Payment Policy

• All classes and services must be paid for at the time of booking unless otherwise stated.
• Payment can be made via credit/debit card, or other methods as specified on our website or our App.
• Privé Pilates reserves the right to change pricing at any time. Changes will not affect existing bookings.

2.3 Refunds and Cancellations

• Cancellations must be made at least 24 hours before the scheduled class to qualify for a refund or reschedule on the booking platform only.
• Late cancellations or no-shows will forfeit the session fee.
• Packages and memberships are non-refundable but may be transferable at the discretion of management.
• Min. attendance per class is at least 2 bookings. If this number has not been reached the class will get cancelled.

3. Studio Policies

3.1 Arrival and Attendance

• Please arrive at least 10-15 minutes before the class starts. Late arrivals may not be admitted to avoid disruption. We have a late- to class policy to ensure safety, minimise disruptions, and maintain the flow of the session. To ensure a safe and effective workout, we kindly ask that all participants arrive on time for class. If you are a beginner, please make sure to arrive 10-15min earlier to make yourself familiar with the studio space. If you are more than 5 minutes late, you may not be allowed to join the session. This is because the warm-up is essential to prevent injuries and ensure you get the most out of your workout and to honour and respect the other participants.
• We have a strict no phone/no filming policy during class. Pictures & Videos can be taken after the class ended and with permission of other attendees.

3.2 Health and Safety

• Participants must complete a health and safety waiver before attending their first class. By booking a class, participants automatically agree to and understand the liability, health and safety waiver, privacy policy, refund policy, and all terms and conditions outlined by Privé Pilates.
• It is the responsibility of participants to review these documents prior to booking.
• Inform the instructor of any injuries, medical conditions, or special considerations prior to class.
•  Privé  Pilates does not engaged in offering medical advice, nor does it hold itself of out as qualified to do so.  Privé Pilates Ltd is not a professional medical body nor does it  intend to diagnose, treat, cure or prevent any disease, nor does it intend to be a substitute for medical treatment. It is recommended that you seek advice from a healthcare professional and/or nutritionist.
• Participants must follow all instructor guidance and studio rules to ensure a safe environment.
• For your safety, you may be required to provide a doctor’s note for certain medical conditions.

3.3 Children and Play Area

• Children are welcome only during designated classes that offer a kids' play area option.
• Parents or guardians are solely responsible for the supervision and safety of their children at all times.
• Privé Pilates and its staff are not liable for any injuries, accidents, or incidents involving children on the premises.

3.4 Personal Belongings

• Privé Pilates is not responsible for loss, theft, or damage to personal belongings. Please use designated storage areas.

3.5 CCTV

• The premises are monitored by CCTV for safety and security purposes. Footage is accessible only by authorized personnel and will not be viewed by any male individuals (see Privacy Policy for details).

3.6 Dress Code and Equipment

• Participants must wear appropriate fitness attire and non-slip socks for classes.
• Equipment provided by the studio must be handled with care. Participants will be responsible for any damage caused by misuse.

3.7 Cleanliness and Hygiene

• Participants are required to sanitize equipment after use.
• If you are unwell, please refrain from attending classes to maintain a healthy environment for all participants.

4. Memberships and Packages

4.1 Membership Benefits

• Memberships and packages may include discounted rates, priority booking, or other perks as outlined in the specific package terms.
• Expected Results: While we believe that for most people, using our products and following our programmes and methods will lead to their desired results, all products and exercise programs depend on the individual. Results will be affected by the effort and commitment of the individual, however in some circumstances even where an individual follows our program and advice, they may not achieve the desired results. We therefore provide no warranties of any kind.

4.2 Expiration

• Packages have an expiration date, which will be communicated at the time of purchase.
• Once active/used Packages/Bundles/Offers/Membership Fee's are non refundable.
• Unused sessions cannot be carried over past the expiration date unless otherwise agreed.

4.3 Membership Suspension or Cancellation

• Memberships may be suspended for medical reasons with supporting documentation.
• Privé Pilates reserves the right to terminate memberships for violations of these Terms.
• Unlimited Class Pass Users agree to cancel on time,  so that Privé Pilates can give out their slots to other customers. No show's and late cancellation are not permitted. After a maximum of 3 strikes, we reserve the right to terminate/cancel the unlimited class bundle without being eligible for a refund.

Privé Pilates reserves the right to terminate memberships/package and bundles for violations of any Terms outlined.

5. Use of Website

5.1 Website Access

• The website is provided "as is" for general information and booking purposes.
• We strive to keep the website accurate and up-to-date but do not guarantee its completeness or reliability.

5.2 Prohibited Use

• You agree not to use the website for unlawful purposes or interfere with its functionality.
• Unauthorized access, hacking, or similar activities are strictly prohibited.

5.3 Third-Party Links

• Our website may contain links to third-party sites. Privé Pilates is not responsible for the content or practices of these external sites.

5.4 Intellectual Property

• All content on our website, including text, images, and logos, is the property of Privé Pilates and protected by intellectual property laws. Unauthorized use is strictly prohibited.

6. Liability

6.1 Assumption of Risk

• By participating in any class or activity, you acknowledge and accept the inherent risks of physical exercise, including the potential for injury.

6.2 Release of Liability

• Privé Pilates, its owners, staff, and instructors are not liable for personal injuries, accidents, or illnesses occurring on the premises or during classes. You agree to indemnify, defend and hold harmless Privé Pilates Ltd and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

6.3 Force Majeure

• Privé Pilates is not liable for cancellations or service interruptions caused by events beyond our reasonable control, including but not limited to natural disasters, government restrictions, or pandemics.

6.4 Insurance

• We recommend that participants have personal health and accident insurance to cover potential risks. You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you. 

In no case shall Privé Pilates Ltd , our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any direct or indirect injury, loss, damage, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, economic loss, injury, illness or death whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law. 

7. Conduct and Behavior

7.1 Respectful Environment

• Participants must treat instructors, staff, and fellow clients with respect.
• Disruptive or inappropriate behavior will not be tolerated and may result in removal from the premises.

7.2 Compliance with Instructions

• Participants must follow the guidance of instructors to ensure a safe and effective workout.

7.3 Zero Tolerance Policy

• Privé Pilates enforces a zero-tolerance policy for harassment, discrimination, or abusive behavior.
• We reserve the right to refuse service to anyone for any reason at any time.

8. Privacy and Data Protection

8.1 Data Collection

• We collect and process personal data in accordance with our Privacy Policy.

8.2 Use of Personal Information

• Personal information is used for booking, communication, and improving our services and marketing purposes.

8.3 Data Security

• We employ reasonable security measures to protect your data but cannot guarantee complete security.

9. Changes to Terms

Privé Pilates reserves the right to update or modify these Terms at any time. We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk. 

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.  Continued use of our services constitutes acceptance of the updated Terms. 

9.1 Errors, Inaccuracies and Omissions

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order). 

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales. In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet.
